Not every organisation needs to register with the Information Commissioner's Office (ICO) or pay the data protection fee.

Whether you need to register depends on what personal information you process and why you process it.

Why does the ICO charge a fee?

Probably yes, if...

  • You don't carry out unusual or high-risk processing. 
  • You're happy to answer a few simple questions about your business.

Common misconceptions

"I'm registered with the ICO, so I'm GDPR compliant."

No.

Registering with the ICO (where required) is only one legal obligation.

You still need to comply with UK GDPR, including having a lawful basis for processing, appropriate privacy information, security measures and processes to protect people's information.

 

"I'm a sole trader, so I don't need to register."

Not necessarily.

Some sole traders do need to pay the fee.

The requirement depends on the type of personal information you process and how you use it—not the size of your business.

 

"I only have employee information."

Some organisations processing only staff records may be exempt, depending on their activities.

It's always worth checking rather than making assumptions.
